1. Scope of application

These General Terms and Conditions (hereinafter "GTC") govern the contractual relationship between comfortnatur (hereinafter "comfortnatur" or "we") and its customers (hereinafter "Customer" or "you") with regard to the goods and services offered through our online presence.

Any deviating, conflicting or supplementary terms and conditions of the Customer shall not become part of the contract unless we have expressly agreed to their validity in writing.

2. Contracting party

3. Conclusion of contract

The presentation of products on this website does not constitute a legally binding offer, but a non-binding invitation to place an order.

By placing an order via our website, you submit a binding offer to conclude a purchase contract. We will inform you by email of the receipt of your order. Acceptance of your offer takes place either by dispatch of the ordered goods or by an explicit order confirmation via email.

4. Prices and payment conditions

All prices are shown in the currency indicated on the product page and include statutory VAT, where applicable. Shipping costs are shown separately and are borne by the Customer in addition, unless free delivery has been explicitly agreed.

Payment may be made using the methods offered on the respective payment page (for example credit card, PayPal or other providers), subject to availability in the Philippines.

5. Delivery and shipping

Delivery is made to the delivery address you specify. Delivery times depend on the selected shipping option and the destination country, including shipments to the Philippines.

If the goods you have ordered are not available, we will inform you without delay. In this case you are entitled to withdraw from the contract.

6. Right of withdrawal

Where applicable under the relevant consumer protection laws, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

To exercise your right of withdrawal, you must inform us by means of a clear statement (for example a letter sent by post or email) about your decision to withdraw from this contract. You may use a withdrawal form template, which is not mandatory.

7. Warranty

Statutory warranty provisions apply to defects in the goods. Any manufacturer guarantees remain unaffected. Your statutory rights as a consumer, including those in the Philippines where applicable, remain unchanged.

8. Liability

We are liable without limitation, to the extent permitted by law, for intent and gross negligence. In the case of simple negligence, we are only liable for the breach of an essential contractual obligation, the fulfilment of which is a prerequisite for the proper performance of the contract and on the fulfilment of which you may regularly rely.

9. Data protection

The protection of your personal data is important to us. Information on the collection, processing and use of your data can be found in our privacy policy.

10. Final provisions

The law applicable to the contract is determined by the mandatory conflict-of-law rules of your country of residence. Mandatory consumer protection regulations of the Philippines or your country of habitual residence remain unaffected.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
